Terms of Service

These Terms of Service ("Terms") govern your access to and use of fdback.io ("Service"), operated by THINK IT FUTURE SRL, a company registered in Romania (CUI: 45074342, Registration No: J2021002965089), with its registered office at Str. Lunga 149 Ap. P3, Cod 500051, Brasov, Romania ("we", "us", "fdback.io").
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree, you must stop using the Service immediately.
You must be at least 16 years of age to use the Service, in accordance with applicable data protection regulations.
These Terms apply alongside our Privacy Policy, which describes how we collect, use, and protect your personal data.
1. Definitions
"Service" means the fdback.io platform, including the web application, embeddable widget, JavaScript SDK, APIs, custom domain hosting, and all related functionality.
"Workspace" means a distinct organizational unit within the Service, created and managed by an Owner, containing feedback boards, roadmaps, changelogs, and members.
"Owner" means the user who created a Workspace and holds full administrative permissions over it.
"Member" means any user with an assigned role in a Workspace (Owner, Admin, Member, Viewer, or a custom role).
"Content" or "User Content" means all feedback posts, comments, votes, attachments, changelog entries, and other materials submitted by users through the Service.
"Anonymous User" means a person who interacts with the Service (voting, posting, or viewing) without creating an account.
"Widget" means the embeddable iframe component and associated JavaScript SDK that can be placed on third-party websites.
"Plan" means the subscription tier (Free, Pro, or Enterprise) that determines feature access and usage limits.
"Third-Party Services" means external platforms and services integrated with or used by the Service, including but not limited to payment processors, email providers, and project management tools.
2. Description of Service
fdback.io is a customer feedback management platform. The Service includes the following features:
2.1 Feedback Management
Feedback boards where users can submit posts (categorized by type such as Feature Request, Bug Report, Improvement, or Question), vote on ideas, post threaded comments with nested replies at any depth, add emoji reactions, subscribe to post updates, attach files, and tag posts for organization. Posts may be archived, merged, or moderated by Workspace administrators. Workspace Owners may enable anonymous posting and voting.
2.2 Public Roadmap
A visual kanban board with customizable status columns (e.g., Backlog, In Progress, In Review, Done) that can be shared publicly. Workspace administrators can control which columns are visible to the public and reorder cards via drag-and-drop.
2.3 Changelog
Public changelog entries with rich text content, featured images, tags (e.g., Feature, Bug Fix, Security), and analytics (view counts, likes). When a feature is shipped and marked complete, users who voted on the original feedback post can be notified automatically.
2.4 AI-Powered Features
Optional artificial intelligence features powered by third-party language model providers (via OpenRouter), including: (a) duplicate post detection, which identifies similar existing feedback before submission; (b) spam filtering, which automatically flags or removes spam content; (c) automatic tagging, which suggests tags for new feedback based on its content; and (d) message ingestion from integrations, which converts messages into structured feedback. AI features are optional and can be individually enabled or disabled per Workspace by the Owner.
2.5 Widget and Embed
An embeddable feedback widget (iframe) and JavaScript SDK (@fdback/sdk) that can be integrated into third-party websites. The Widget allows visitors to submit feedback, vote, view the roadmap, and read changelog entries without leaving the host website. The Widget can be customized with brand colors and theme settings.
2.6 Integrations
Connections to third-party platforms including Slack (notifications and message-to-feedback ingestion), Discord (notifications and forum thread creation), Linear (issue synchronization), Asana (task synchronization), Apple App Store (review import), Google Play Store (review import), and custom webhooks.
2.7 Data Import and Export
Import feedback from other platforms (CSV format). Export all Workspace data (posts, comments, votes, members, changelogs, tags, statuses, roles, and activity logs) in JSON or CSV format, available to users with export permissions.
2.8 Custom Domains
The ability to serve your public feedback board on a custom domain (e.g., feedback.yourcompany.com) instead of the default fdback.io subdomain. Available on Pro and Enterprise plans. Managed through Vercel's domain infrastructure with automatic SSL provisioning.
2.9 Notifications
In-app notifications and email notifications (via SendGrid) for events including new feedback, comments on followed posts, vote notifications, status changes, Workspace invitations, and periodic digest summaries. Notification preferences are configurable per user and per notification type.
2.10 Analytics
Optional product analytics (via PostHog) and changelog engagement tracking (views and likes), including tracking of anonymous interactions by IP address.
3. Account Registration and Security
You may create an account using Google OAuth or a magic link sent to your email address (passwordless authentication via SendGrid). You agree to:
Provide accurate and complete information when creating your account.
Maintain the security and confidentiality of your account credentials.
Not share your account with others or create multiple accounts.
Notify us promptly of any unauthorized access to your account.
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Anonymous Access and IP Tracking
Workspace Owners may enable anonymous voting and/or anonymous posting for their public feedback boards. When anonymous features are enabled:
Anonymous interactions (votes, posts, views, and likes) are tracked by IP address to prevent abuse, such as duplicate voting from the same source.
IP addresses of Anonymous Users are stored in our database and associated with their interactions.
Anonymous Users are bound by these Terms, including the Acceptable Use Policy (Section 7).
Workspace Owners who enable anonymous access are responsible for informing their users about data collection practices and for managing the content submitted through anonymous channels.
Anonymous Users have limited rights under these Terms. Without an account, there is no profile to manage, no data export capability, and no account to delete. Anonymous data may be removed upon request by contacting us at support@fdback.io.
5. Workspaces, Roles, and Permissions
5.1 Workspaces
Users may create and join multiple Workspaces, subject to their Plan limits. Each Workspace operates independently with its own feedback boards, roadmap, changelog, members, roles, and settings.
5.2 Roles and Permissions
Each Workspace has four default roles — Owner, Admin, Member, and Viewer — with pre-defined permission sets. Workspace Owners may also create custom roles with granular permissions spanning Feedback, Roadmap, Changelog, and Workspace administration categories.
5.3 Workspace Owner Responsibilities
The Workspace Owner is responsible for managing membership, assigning roles, moderating content, and configuring settings (including anonymous access, AI features, and integrations) within their Workspace.
5.4 Invitations and Membership
Members are invited via email. Invitations expire after a set period. Members may leave a Workspace at any time. Owners and authorized administrators may remove members.
6. Subscription Plans and Billing
6.1 Plans
The Service offers three subscription tiers — Free, Pro, and Enterprise — each with different feature access and usage limits. The Free plan is available indefinitely at no cost and includes core functionality. No credit card is required to use the Free plan. 6.2 Billing
Payments are processed securely by Stripe. Subscriptions are available in monthly and annual billing periods. All fees are stated in USD and are exclusive of applicable taxes unless otherwise stated.
6.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until then. No prorated refunds are provided for partial billing periods.
6.4 Plan Enforcement and Read-Only Mode
If your usage exceeds your Plan limits (for example, after a downgrade), excess Workspaces may be placed in read-only mode. In read-only mode, existing content remains accessible but no new content can be created. To restore full functionality, you must upgrade your Plan or reduce usage to within your current Plan limits.
6.5 Price Changes
We reserve the right to change subscription pricing. Existing subscribers will be given at least 30 days' notice before any price change takes effect on their account.
7. Acceptable Use Policy
7.1 General Conduct
You agree to use the Service lawfully, respectfully, and in accordance with these Terms.
7.2 Prohibited Content
You must not submit Content that is: (a) illegal or promotes illegal activity; (b) defamatory, harassing, threatening, or abusive; (c) obscene or pornographic; (d) infringing on the intellectual property rights of others; (e) spam, phishing, or unsolicited commercial messages; (f) malicious code, malware, or executable scripts; (g) misleading, deceptive, or fraudulent; or (h) personally identifiable information of others without their consent.
7.3 Prohibited Actions
You must not: (a) attempt to gain unauthorized access to the Service, other user accounts, or systems connected to the Service; (b) reverse engineer, decompile, or disassemble any part of the Service; (c) use automated means (bots, scrapers, crawlers) to access the Service except through the official API or SDK; (d) circumvent rate limits, plan limits, or other usage restrictions; (e) manipulate voting by creating multiple accounts or using technical means to bypass IP-based vote deduplication; (f) interfere with or disrupt the operation, security, or performance of the Service or its infrastructure.
7.4 Upload Rules
Uploaded files must comply with this Acceptable Use Policy. You must not upload: executable files, scripts, or malware; copyrighted material without proper authorization; explicit, illegal, or harmful imagery. File size and count limits are enforced per upload type.
7.5 Integration Misuse
You must not use integrations (webhooks, Slack, Discord, Linear, Asana, or other connected services) to send spam, relay malicious content, or violate the terms of service of the third-party platform.
7.6 Enforcement
We may remove Content, restrict features, suspend accounts, or terminate access for violations of this Acceptable Use Policy. For automated content moderation, see Section 10.
8. File Uploads and Storage
Files uploaded to the Service are stored by UploadThing, a third-party file hosting provider. Supported file types include images, PDFs, and videos. File size and count limits are enforced per upload type and may be updated from time to time.
We reserve the right to remove files that violate the Acceptable Use Policy. When attachments are deleted from posts, the corresponding files are removed from storage.
9. Intellectual Property
9.1 Platform Intellectual Property
The Service, including its software, design, branding, logos, documentation, and all related intellectual property, is owned by THINK IT FUTURE SRL. No rights are granted to you except as explicitly stated in these Terms.
9.2 License to User Content
By submitting Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, reproduce, and distribute your Content solely for the purpose of operating and providing the Service. This includes displaying Content on public boards, roadmaps, changelogs, and embedded widgets.
9.3 Content Ownership
You retain ownership of all Content you submit. We do not claim ownership of any User Content.
9.4 Feedback About the Service
Any suggestions, ideas, or feedback you provide about the Service itself (not to be confused with feedback posts within Workspaces) may be used by us without any obligation or compensation to you.
9.5 Workspace Owner Content Rights
Workspace Owners control the visibility, management, and deletion of Content within their Workspace. Content posted to a public Workspace is visible to the public. Workspace Owners may export, archive, or delete Content within their Workspace in accordance with their permissions.
10. AI Features and Automated Content Moderation
10.1 AI Processing
The Service uses artificial intelligence powered by third-party language model providers (accessed via the OpenRouter API) to provide the following optional features: (a) duplicate post detection, (b) spam filtering, (c) automatic tagging, and (d) message ingestion from integrations.
10.2 Data Sent to AI Providers
When AI features are enabled for a Workspace, the titles and descriptions of feedback posts may be sent to third-party AI model providers for processing. Personal account information (such as names and email addresses) is not sent to AI providers as part of these features.
10.3 Automated Decision-Making
AI features may automatically: flag posts as spam (with configurable actions: mark for administrator review or auto-delete), suggest duplicate matches, or apply tags. These are automated decisions that can be reviewed and overridden by Workspace administrators.
10.4 Opting Out
Workspace Owners may enable or disable each AI feature individually (duplicate detection, spam detection, auto-tagging) at any time through Workspace settings.
10.5 Accuracy
AI features are provided on a best-effort basis. We do not guarantee the accuracy or completeness of AI-generated suggestions, spam classifications, or duplicate detections.
11. Widget, Embed, and SDK Terms
The fdback.io Widget is an iframe-based component and JavaScript SDK (@fdback/sdk) that can be embedded on third-party websites to collect user feedback.
The Widget communicates with fdback.io servers and all interactions are subject to these Terms.
The Widget may collect data from visitors of the embedding website, including feedback submissions, votes, comments, and IP addresses (for anonymous interaction tracking).
Website owners who embed the Widget are responsible for informing their visitors about data collection practices, including updating their own privacy policies to disclose the use of fdback.io.
The Widget inherits the Workspace settings of the associated Workspace (e.g., anonymous voting, anonymous posting, public registration).
Widget sessions are scoped to a specific Workspace and cannot access data from other Workspaces.
We are not responsible for the content, practices, or policies of third-party websites that embed the Widget.
Third-Party Services and Data Processors
The Service relies on the following third-party services to operate:
Stripe (stripe.com) — Payment processing for subscriptions
SendGrid (sendgrid.com) — Email delivery (magic links, invitations, notifications, digests)
UploadThing (uploadthing.com) — File upload and storage
OpenRouter (openrouter.ai) — AI model routing for content moderation and analysis
Vercel (vercel.com) — Application hosting, custom domain management, edge caching
Neon (neon.tech) — PostgreSQL database hosting
PostHog (posthog.com) — Product analytics (optional)
Google (google.com) — OAuth authentication
When you connect integrations, data may also be shared with: Slack, Discord, Linear, Asana, Apple App Store (iTunes API), and Google Play Store as applicable to the integration you configure.
Each third-party service processes data in accordance with its own terms of service and privacy policy. We maintain data processing agreements with our sub-processors as required by applicable data protection regulations.
Custom Domains
Custom domain support is available on Pro and Enterprise plans.
One custom domain may be configured per Workspace.
Custom domains are provisioned through Vercel's domain infrastructure. DNS configuration is the responsibility of the user.
SSL certificates are provisioned automatically for verified custom domains.
DNS propagation may take up to 48 hours. We are not responsible for DNS configuration issues on your end.
Upon Plan downgrade to a tier that does not support custom domains, your custom domain configuration will be disabled but not deleted. It can be re-enabled upon upgrading to an eligible Plan.
Integrations, Webhooks, and API
Integration availability is subject to your Plan and its limits.
Webhook payloads are signed using HMAC-SHA256. You are responsible for validating webhook signatures on your end.
API access is available on Pro and Enterprise plans.
When connecting integrations, OAuth tokens are stored securely and used only for the purposes you have configured.
We are not responsible for failures, data loss, or service disruptions caused by third-party integration services.
You must comply with the terms of service of any third-party platform you connect through the Service.
We may rate-limit API and webhook requests to protect the stability and performance of the Service.
Data Protection and GDPR
15.1 Data Controller and Processor Roles
With respect to Content submitted within Workspaces, fdback.io acts as a data processor on behalf of the Workspace Owner (the data controller). For user account data (name, email, authentication information), fdback.io acts as a data controller.
15.2 Data Subject Rights
Under the General Data Protection Regulation (GDPR) and applicable data protection laws, you have the right to: (a) access your personal data; (b) rectify inaccurate data; (c) request erasure of your data; (d) restrict processing; (e) data portability; and (f) object to processing. To exercise these rights, contact us at support@fdback.io.
15.3 Data Export
Workspace Owners (or users with the export permission) can export all Workspace data in JSON or CSV format, including posts, comments, votes, members, changelogs, tags, statuses, roles, and activity logs.
15.4 Account Deletion
You may delete your account from the account settings page. To do so:
You must first leave all Workspaces you are a member of. If you are the Owner of a Workspace, you must either transfer ownership or delete the Workspace before proceeding.
You must type "DELETE" as confirmation.
Account deletion is permanent and cascades to your sessions, authentication records, and account data.
Content you previously submitted to Workspaces (posts, comments) may be retained within the Workspace but will no longer be associated with an identifiable account.
15.5 Data Retention
Account data is retained for the duration of your account and deleted upon account deletion. Workspace data is retained until the Workspace is deleted by its Owner. Anonymized or aggregated data may be retained for analytical purposes.
15.6 International Data Transfers
Your data may be transferred to and processed in countries outside the European Economic Area (EEA) where our sub-processors operate. Such transfers are protected by appropriate safeguards, including Standard Contractual Clauses or adequacy decisions, as required by applicable law.
15.7 Data Breach Notification
In the event of a personal data breach that poses a risk to your rights and freedoms, we will notify affected users and the relevant supervisory authority within 72 hours, as required by GDPR.
Account Termination and Suspension
16.1 Termination by You
You may delete your account at any time, subject to the requirements described in Section 15.4. You may cancel your subscription at any time as described in Section 6.5. Workspace Owners may delete their Workspace, which permanently removes all associated data.
16.2 Termination by Us
We may suspend or terminate your account or Workspace if you: (a) violate these Terms; (b) engage in illegal activity through the Service; (c) pose a security risk to the Service or other users; or (d) fail to pay applicable fees. We will make reasonable efforts to notify you before taking action, except in cases of severe or urgent violations.
16.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. Data may be retained for a reasonable period to comply with legal obligations. Active subscriptions will not be refunded upon termination for cause.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-POWERED FEATURES.
WARRANTIES REGARDING THE AVAILABILITY OR PERFORMANCE OF THIRD-PARTY SERVICES.
No advice or information, whether oral or written, obtained through the Service creates any warranty not expressly stated in these Terms.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) EUR 100.
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable law, including mandatory EU consumer protection laws.
Limitation of Liability
You agree to indemnify, defend, and hold harmless THINK IT FUTURE SRL, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) your use of the Widget on third-party websites.
This indemnification obligation survives termination of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Brasov, Romania.
Before initiating legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days from the date of written notice of the dispute.
For EU consumers: nothing in this section affects your rights under mandatory consumer protection laws of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, government actions, power failures, telecommunications or Internet disruptions, or third-party service outages. The affected party shall promptly notify the other party and make reasonable efforts to mitigate the effects of the event.
Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users or through a notice within the Service at least 30 days before they take effect.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may request account deletion as described in Section 15.4.
Miscellaneous
Severability. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and fdback.io regarding the Service, superseding any prior agreements.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. We may assign or transfer these Terms, in whole or in part, without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.
No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
Notices. We may provide notices via email to the address associated with your account. You may contact us at the address listed in Section 24.
Headings. Section headings are for convenience only and have no legal or contractual effect.
